Article 2 – Purpose

These T&Cs define the rights and obligations of Black Phenix Revolution and the customer regarding the sale of products online via www.blackphenixrevolution.com. Placing an order implies full and unreserved acceptance of these terms.


Article 3 – Products

The products sold on the site are manufactured, printed, and shipped either by Black Phenix Revolution or through third-party providers. Images are non-contractual. Variations in color or texture may occur due to display settings or supplier stock.


Article 4 – Orders

Any order is considered final once payment is confirmed. A confirmation email will be sent to the customer with a summary of their purchase.

Black Phenix Revolution reserves the right to refuse or cancel an order in case of a dispute with the customer.


Article 5 – Prices and Payment

All prices are displayed in euros including VAT. Prices may be modified at any time without prior notice.

Payment is due immediately and is made via secure methods provided on the website (e.g., Stripe, PayPal).


Article 6 – Shipping

Products are shipped from our facilities or third-party logistic centers (EU, USA, etc.). Standard delivery times range from 7 to 15 business days. Additional delays may apply for custom items, remote regions, or special circumstances.

Black Phenix Revolution is not responsible for delivery delays caused by the carrier or incorrect/incomplete delivery information provided by the customer.


Article 7 – Right of Withdrawal

In accordance with EU law, customers have 14 days from receipt of their order to exercise their right of withdrawal, except for personalized items.

Requests must be sent via email to shopify@blackphenixrevolution.com. Returned products must be in original condition and returned at the customer’s expense.

Refunds are issued within 14 days of receiving and inspecting the returned item.


Article 8 – Returns & Refunds

Defective, incorrect, or damaged items may be replaced or refunded upon photo evidence within 15 days.

RETURN POLICY:
We have a 15-day return policy, which means you have 15 days to return your items from the day you receive your order. This return period starts from the date you receive your order.

Please note that a fee of at least €6 will be charged for returning items.

If you choose to return the items using a method other than one of our designated carriers (available through our returns service), you will be responsible for the items, including any loss or damage, until we receive
them.

To be eligible for a return, your item must be in the same condition as you received it, unworn or unused, with tags, and in its original packaging. You will also need the receipt or proof of purchase.

To start a return, you can contact us at shopify@blackphenixrevolution.com. The return address will be provided to you once we confirm acceptance of your return.

If your return is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

Damages and issues
Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

Exceptions / non-returnable items
Certain types of items cannot be returned, like perishable goods (such as food, flowers, or plants), custom products (such as special orders or personalized items), and personal care goods (such as beauty products).
We also do not accept returns for hazardous materials, flammable liquids, or gases. Please get in touch if you have questions or concerns about your specific item.

Unfortunately, we cannot accept returns on sale items or gift cards.

Exchanges
The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.

European Union 14-Day Cooling Off Period
YOUR RIGHT TO A REFUND (EEA CUSTOMERS ONLY)
Notwithstanding the above, if the merchandise is being shipped into the European Union, you have the right to cancel or return your order within 14 days, for any reason and without a justification. As above, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

Indeed, if you are a consumer in the EEA and you cancel your Contract under clause 8.1:

  • we will refund you the price paid for the items (minus the €6 return fee for the items). Note that we may reduce the amount of the refund to account for any depreciation in the items which has resulted from your handling them beyond what is necessary to establish their nature, characteristics, and functioning. If we refund you the price paid before we have inspected the items and later discover that you have handled them in an nacceptable way, you will be required to pay us an appropriate sum; 
  • we will refund all amounts you have paid for delivery of the products, although the maximum refund for delivery costs will be the cost of delivery by the least expensive delivery method we offer to your destination;
  • we will make the refund using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the refund. We will make the refund:
    1. 14 days after the day on which we receive the items back from you or, if earlier, the day on which you provide us with evidence that you have sent the items back to us using one of our approved carriers; or
    2. 14 days after you inform us of your decision to cancel the Contract.
    3. If you choose to return the items using a method other than one of our designated carriers, you will be responsible for the items until they reach us, and we will not be obliged to provide a refund if we do not receive the items or if they are damaged upon receipt. In such circumstances, you should contact the carrier you used to return the items.

Refunds
We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 business days. Please remember it can take some time for your bank or credit card company to process and post the refund too.

Article 9 – Warranty & Compliance

Products comply with the General Product Safety Regulation (GPSR) and relevant EU standards, including REACH.


Article 10 – Intellectual Property

All visual, graphic, and textual content on the site is the exclusive property of Black Phenix Revolution and cannot be reproduced without prior written permission.


Article 11 – Personal Data

Data is collected to manage orders and is treated confidentially. Customers may request access, correction, or deletion by contacting shopify@blackphenixrevolution.com.

Article 12 – Disputes

These T&Cs are governed by French law. In case of dispute, an amicable solution will be sought before legal proceedings. Failing which, French courts will have exclusive jurisdiction.
